Abstract

Developments towards three-dimensional cadastral systems are the subject of numerous international research projects. In South Africa, there is a need for the option to convey three dimensional rights, restrictions and responsibilities, particularly in urban areas and above or below ground complex situations where overlapping or interlocking rights spaces exist. This paper emerges from a larger study and motivates the need by describing two of the four cases assessed. It investigates the legal environment of cadastral parcels in South Africa to ascertain whether there is a possibility of inclusion of 3D RRRs without major legislative change. A subsequent paper will propose a conceptual way forward for consideration of 3D cadastral representations.
